Terms of Service
These terms are the agreement between you and Promiyo when you use our service. Please read them. By starting a pilot or using the service, you agree to them.
1. What the service is
Promiyo sends review requests to a business's clients on its behalf, with follow-up reminders and a link to the business's Google review page. We act as a service provider and follow the instructions of the business we work with.
2. Accepting these terms
These terms apply when you sign up, start a pilot, or use the service. Keep your account details secure and tell us right away at hello@promiyo.com if you think someone else has access.
3. Business use only
The service is for businesses and business use only. It is not a consumer product.
4. The founding pilot, fees, and taxes
The founding pilot is free for a limited number of businesses. After the pilot, continued use is a paid subscription at the price shown at sign-up, plus any tax that applies. There is no long-term contract, and you can cancel with effect from the end of your billing period. Fees are non-refundable except where a refund is required by law.
5. Your clients and consent are your responsibility
You confirm that the people on any list you give us are your genuine clients, and that you have the consent needed to contact them under the laws that apply, including US texting and email rules such as the TCPA and CAN-SPAM, applicable US state laws, and, where relevant, the GDPR. You are responsible for keeping records of that consent. Phone carriers may filter or block messages, which is outside our control.
6. Review integrity
We follow Google's policies. We do not, and you must not ask us to:
- create fake reviews or reviews from people who are not real clients;
- offer money, discounts, or gifts in exchange for reviews;
- screen clients by how happy they are before asking (review gating);
- require a certain star rating, keyword, or staff name.

7. No guarantees
We do not guarantee a specific number of reviews, a specific star rating, or any Google Maps or search ranking. Reviews can help your visibility, but no one can promise a ranking. Any examples we show are real outcomes, not promises.
8. Not legal advice
Anything we say about the TCPA, GDPR, or Google's policies is general information, not legal advice. You are responsible for your own compliance.
9. Your data and feedback
You keep ownership of your client lists. You give us a limited, non-exclusive license to use that data only to run the service for you. We may use anonymized, aggregated data to improve the service. If you send us feedback, we can use it freely.
10. Confidentiality
Both sides keep each other's non-public business information confidential and use it only to run the service. Your client lists stay confidential and are never sold or used for our own marketing.
11. Our intellectual property
The site, the service, and our content belong to us. While your account is active, you have a limited, non-exclusive, non-transferable right to use the service.
12. Third-party services
The service relies on others, such as Google, our booking, messaging, payment, and hosting providers. We are not responsible for their actions, outages, or policy changes.
13. Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose, or non-infringement. We do not promise the service will be uninterrupted or error-free.
14. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, or consequential damages, or lost profits. Our total liability is limited to the amount you paid us in the three months before the claim.
15. Indemnification
You agree to cover claims that arise from the lists or content you give us, from contacting your clients without the right consent, or from your breach of these terms.
16. Termination
You can cancel any time. We may suspend or end the service for non-payment, breach, or harmful use. You own your lists and should export anything you need before cancelling.
17. Governing law
These terms are governed by the laws of the Czech Republic, and disputes are subject to the courts of the Czech Republic, unless a mandatory law gives you other rights.
18. Changes to these terms
If we make a material change, we will give notice and update the date above. Continuing to use the service after a change means you accept it.
